PT EnakPay Innovation Labs Venue Terms and Conditions
1. Introduction Welcome to PT EnakPay Innovation Labs. These Terms and Conditions govern the use of EnakPay's ordering and payment system by venues ("Venue," "You," or "Your"). By registering for and using EnakPay, you agree to comply with these Terms and Conditions.
2. Services Provided EnakPay provides an online ordering and payment system that allows customers to place orders and make payments directly through a QR-based interface. The system includes order management, payment processing, and refund functionality.
3. Registration and Account Management
To use EnakPay, Venues must complete the registration process and provide accurate information.
Venues are responsible for maintaining the confidentiality of their account credentials.
EnakPay reserves the right to suspend or terminate accounts for violations of these terms.
4. Payment Processing and Fees
Payments are processed through a third-party payment gateway, Xendit.
EnakPay charges a transaction fee, a subscription fee, or a percentage-based commission, as agreed upon during onboarding.
All fees are deducted automatically before funds are transferred to the Venue.
Venues are responsible for any applicable taxes and payment gateway fees.
5. Refunds and Chargebacks
Refunds must be processed through the EnakPay system and require admin password confirmation.
Customers will receive an email notification upon refund initiation, and refunds will be processed within a specified timeframe.
Venues are responsible for any chargebacks and disputes related to orders.
6. Order Management and Responsibilities
Venues must ensure timely preparation and delivery of orders placed through EnakPay.
EnakPay is not responsible for issues related to food quality, delivery, or order fulfillment.
Venues must update menu items, prices, and availability within the system to prevent discrepancies.
7. Equipment and System Requirements
Venues are responsible for ensuring their internet connection and hardware (such as printers and POS systems) are compatible with EnakPay.
EnakPay provides technical support but is not liable for disruptions caused by third-party hardware or network failures.
8. Data Privacy and Security
EnakPay collects and processes customer data in compliance with applicable privacy laws.
Venues must not misuse customer data obtained through the system for unsolicited marketing or other unauthorized purposes.
EnakPay implements security measures but is not liable for breaches caused by external threats beyond its control.
9. Limitation of Liability
EnakPay is not liable for indirect, incidental, or consequential damages arising from the use of its services.
The maximum liability of EnakPay shall not exceed the total amount of fees paid by the Venue in the past three months.
10. Termination and Suspension
Either party may terminate this agreement with prior written notice of 30 days.
EnakPay reserves the right to suspend or terminate services if the Venue violates these Terms and Conditions.
Upon termination, any outstanding payments and obligations must be settled.
11. Modifications to Terms
EnakPay reserves the right to update these Terms and Conditions at any time.
Venues will be notified of significant changes, and continued use of the service constitutes acceptance of the revised terms.
12. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Indonesia.
Any disputes shall be resolved through mediation first, followed by legal proceedings in an Indonesian court if necessary.
By using EnakPay, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
